The General Court (GC) clarified the proportionality of coronavirus-related State aid in a ruling on 29 March 2023. In Wizz Air Hungary (Case T-142/21), the GC dismissed an action for annulment launched by Wizz Air Hungary against a commission decision on Romanian State aid to Blue Air, stating that the commission did not misapply Article 107(2)(b) TFEU in its approval of the State aid. The aid was constituted in a 100% State guarantee on a loan of slightly more than €62m with subsidised interest rates in favour of Blue Air, a Romanian airline, to make good the damage suffered due to the cancellation or rescheduling of flights following travel restrictions imposed during the COVID-19 pandemic. The GC rejected Wizz Air’s pleas for failing to substantiate some accusations, and it found no evidence of the commission committing a manifest error of assessment. The court stated that, under Article 107(2)(b) TFEU, aid to make good the damage caused by natural disasters or exceptional occurrences is compatible with the internal market, and there is no requirement for Member States to grant aid to all victims of that damage.
