A businessman left brain damaged after he slipped on spilt Baileys at Heathrow is suing for more than €5.8m (£5m).
Andreas Wuchner suffered a “traumatic injury” after slipping in the alcohol dropped by a passenger near a British Airways checkin desk in November 2017.
Mr Wuchner, who ran an office supplies company, claims the impact of the fall meant his company folded months later and he will never work again.
He is suing BA over the accident, claiming more than £5m in compensation for his injuries and for the loss of his business career.
Under “strict liability” rules, he is entitled to at least £120,000 damages but lawyers for BA are set to argue that he is not entitled to any more in the case due to be heard next month at Central London County Court.
BA’s barrister, Tom Bird, told Judge David Saunders that Mr Wuchner, who is from Switzerland, is claiming “special damages” due to the alleged impact on his business and work.
According to a witness statement, Mr Wuchner claims the brain injury he sustained in his fall has left him with repeated headaches “which can last continuously for up to two weeks”.
Judgment has been entered in favour of Mr Wuchner under the Montreal Convention, the law which governs payouts for injuries suffered by passengers embarking on international flights.
But he claims he is entitled to much more than the normal limit, arguing that BA could have done more to avoid the accident.
The claim will return to be heard by a judge during a four-day trial at the London court.
